USPS ballot-mail requirements are in active federal litigation
On September 4, the District of Massachusetts preliminarily enjoined specified mandatory USPS ballot-envelope, portal, voter-enrollment and non-delivery requirements for elections through November 3. On September 10, the First Circuit denied requests to stay that injunction. On September 13, the District of Columbia separately preliminarily enjoined USPS from implementing and enforcing the final ballot-mail rule. The government withdrew its earlier Supreme Court application 26A297 and sought a stay of the Massachusetts injunction in No. 26A305; the Supreme Court denied that application on September 14. These are interim orders, not final judgments on the merits. On October 16, the District of Massachusetts dockets in Nos. 1:26-cv-11549 and 1:26-cv-13917 each recorded a First Circuit judgment and mandate; the free official record does not include their text or show which appeal they resolve, so this alert does not describe their effect. The cited appellate and Supreme Court records were reopened October 28; lower-court proceedings and later orders still require monitoring.
That means we have no confirmed current alert for this state. It does not mean no dispute, bill, administrative change, or case exists. Use the named election office above for current voter instructions.

Key dates, with the office that set each one
Primary, runoff, special-election, registration, request, return, and early-voting dates vary by state and territory. We show a date here only after checking the official record that sets it.
The national House and Senate date is not a local election notice. Do not assume that no election exists; use the official election-office directory to check current general, special, or local election notices and deadlines.
Five things to check
First confirm whether and when an election is scheduled for your address. Complete these on the official site for your jurisdiction. Recheck after any move, name change, registration notice, or court-driven rule change.
- 01Check registration statusConfirm the name, residential address, and current status.
- 02Fix a problem earlyContact the local election official if the record is missing, inactive, suspense, or incorrect.
- 03Choose a voting methodRead the current in-person, early, mail, military, or overseas rules.
- 04Verify ID and deadlinesUse the current official list, not a social post or an old election guide.
- 05Confirm the location againPolling places and hours can change. Recheck near the day you plan to vote.
Start with your local election office
Ask the election official what rule applies, what document is missing, and what deadline controls. Keep the name of the office, the time, and any written notice. Power & Politics does not determine rights or replace legal counsel.
The November 3, 2026 federal election date for regularly scheduled Senate and House contests follows 2 U.S.C. § 1 and 2 U.S.C. § 7. This national date does not establish an election date for American Samoa. State and local officials administer elections differently. The national route is the U.S. Election Assistance Commission state directory, with registration guidance at Vote.gov. Page framing was last reviewed Sep 22, 2026; every legal alert and jurisdiction role carries its own independent review date.
