Lee v. Nationwide Mutual Insurance Co.

UPHELD status graphic: Lee v. Nationwide Mutual Insurance Co.. 970970 Lee v. Nationwide Mutual Insurance Co. 02/27/1998 In a case involving injuries sustained in an automobile accident which occurred when three young people were riding in a stolen car late at night, the trial court correctly determined that the defense of illegality barred a claim for damages by a 13-year- old boy, striking the plaintiff's evidence as a matter of law rather than submitting to the jury the issue of the boy's consent to the illegal act. That holding is affirmed.
